What is the Aboveground Petroleum Storage Tank Act?

The Aboveground Petroleum Storage Tank Act (Health & Safety Code Chapter 6.67) is administered in Tulare County by the Regional Water Quality Control Board (SWRCB) and the State Water Resources Control Board. All facilities storing "petroleum" in a single tank larger than 1,320 gallons, or with a cumulative storage capacity of greater than 1,320 gallons are subject to the Act. Businesses that are subject to this law are required to file a storage statement with the SWRCB, pay a facility fee to the state, and, with certain exceptions, prepare and implement a federal Spill Prevention Control and Countermeasure (SPCC) Plan. The object of the SPCC Plan is to prevent leaks from aboveground petroleum storage tanks from reaching sources of drinking water. Requirements for preparation of an SPCC may be found at www.swrcb.ca.gov/cwphome/agt/.The role of the Tulare County Environmental Health Services Division in this program is to verify whether an SPCC plan is in place at facilities that are covered by this law. This is carried out in conjunction with our hazardous materials business plan and hazardous waste generator inspections.
