Above Ground Petroleum Storage Act(APSA)
The Aboveground Petroleum Storage Act (Health & Safety Code Chapter 6.67) covers all non-exempt facilities storing petroleum in a single tank larger than 1,320 gallons, or with an aggregate storage capacity of greater than 1,320 gallons. Businesses that are subject to APSA are required to prepare and implement a Spill Prevention Control and Countermeasure (SPCC) Plan in accordance with federal law.
CUPA is required to conduct inspections at tank facilities with an aggregate storage capacity greater than or equal to 10,000 gallons of petroleum at least every three years. The purpose of the inspection is to determine whether the owner or operator is in compliance with the SPCC plan requirements of APSA.
